Terms and Conditions

You(client) are hiring Brandbutter Creative (production company), to provide the services outlined within the video package you selected for the total price outlined within the selected video package.

As our customer, you have the power and ability to enter into this contract on behalf of your company or organization. You agree to provide us with everything that we need to complete the project including brand guides, images, fonts, any additional media requested to be used in your video project and other information as and when we need it, and in the format requested. You agree to review our work, provide feedback, and sign-off approvals in a timely manner and are bound by any deadlines that we set together. You also agree to keep to the payment schedule set out in this proposal.

We will endeavor to meet all the deadlines set but are not responsible for a missed launch date or a deadline if you have been late in supplying materials or have not approved the work on time at any stage. We will also maintain the confidentiality of any information provided or required in order to fulfill this agreement.

Revisions/Time/Deliverables:

REVISIONS: The Client will be allotted 1 revision request for each video. Any additional revision requests will be subject to additional fees. Revisions are defined as a change request to spelling, fonts, shot placement, or recorded audio. Revisions do not include any re-shoots or re-recordings of audio of any kind.  

TIMELINE:  Please refer to the delivery timeline provided in the package you selected. Please note that while our goal is to always hit or surpass expected timelines, delays can arise. If your video will be delivered after the anticipated timeline date, we will provide notice on the updated delivery day. Refunds or discounts are not provided as a result of a delivery timeline being extended by production company. 

Unless Otherwise Noted, the below delivery rules apply:

DELIVERY: 1080p HD Web, Mobile and TV Formats – 1920 x 1080 MP4

4K Final Delivery Available at additional cost (due to the purchase/cost of additional memory and drives) Packages DO NOT include the cost of travel or per diemPricing is subject to change. RAW Footage is available for purchase.

NOTE: Every client has unique needs and these details are general; your project may vary based on deliverables, filming days, location, travel, and timing.

Refund/Reshoot Policy:

Reshoot Policy – Live production/Trade Show videos can not be rescheduled as they are scheduled on a first come/first serve basis and dependent on the length allowed per event.

Refund Policy – In order for the Production Company to offer reasonable per-image/video rates, we cannot offer a reshoot/revision/refund to any order. To receive the results you are wanting, each client must be as specific as possible with their requests.

Right or Refusal and Termination:

The Production Company reserves the right to terminate the provision of Services, if: the videographer, or any person(s) employed or contracted by the Production Company is placed in a position where there is an actual or apparent risk of injury; or there is a risk that any of the equipment used may be damaged. If the Production Company terminates the provision of services then any deposit paid by the Client is non-refundable. The Production Company may seek compensation from the Client for any loss or damage suffered.

The Client may terminate the contract at any time by written notice of termination, and on settlement of account. When the Client terminates the contract, they will remain liable to pay in full for all work previously undertaken and in progress by the Production Company unless any other written agreement is reached in advance. 

Stock Videography & Photography:

Any request to buy stock video or photographs will an additional cost and added to the final payment due. 

Technical support

We do not offer or include technical support for website hosting, email, or other services relating to website hosting, other than those services listed within your selected video package.

Copyrights:

You guarantee to us that any elements of text, graphics, photos, designs, trademarks, or other artwork that you provide us for inclusion in the website are either owned by you or that you have permission to use them.

When we receive your final payment, copyright is automatically assigned as follows:

You own the final delivered video and can use the video as per this agreement. The Production Company maintains the ownership rights to all RAW video footage. 

We also reserve the right to display and link to your completed project as part of our portfolio and to write about the project on websites, in magazine articles, and in books.

Contact Terms

This contract can not be transferred to anyone else without prior permission. This contract stays in place and need not be renewed.
